REPRESENTATIVE CASES

  • 1987 – A $1.5 Million settlement from a big three auto manufacturer arising out of the wrongful death of the owner of a defectively designed automobile.

  • 1988 - A $5.2 million settlement from a big three auto manufacturer arising out of the permanent disability of a driver caused by a defectively designed and manufactured automobile.

  • 1989 - A $1.2 million settlement arising from injuries received by a minor from an attack by a wild animal at a local mall

  • 1990 - A $1.2 million settlement arising out of a wrongful death from a railroad crossing accident.

  • 1991 – A $50 million settlement for minority shareholders arising out of a shareholder derivative action in which the majority shareholders and the Board of Directors were alleged to have committed fraud upon the minority shareholders.

  • 1992 – A $2.5 million settlement on behalf of two manufacturers representatives against the WD-40 Co. for breach of contract.

  • 1993 – A $1.2 million settlement against one of the nation’s largest banks for breach of a commitment agreement.

  • 1994 – A $12.5 million judgment against the WD-40 Co. on behalf of eight manufacturers representatives for breach of contract.

  • 1995 - A $1.5 million settlement with a major insurance company resulting from the bad faith failure to pay medical claims under ERISA.

  • 1996 – A $1.2 million settlement against a large commercial law firm for legal malpractice.

  • 1997 – A $6.0 million settlement for a boat manufacture against one of the nation’s ten largest banks on a lender liability claim.

  • 1998 - A $2.1 million settlement for an investor against one of the nation’s largest brokerage houses on churning and unsuitability claims.

  • 2000 - A $3.0 million settlement against an insurer for a property owner arising out of a commercial, contract, employment, lender liability, medical malpractice, product liability, and securities

  • 2002 – A $6.1 million dollar judgment against Geoenergy International Corp. and two of its officers for fraud and breach of a joint venture contract.

  • 2002 - A $15 million judgment against DeBartolo Realty Co. and Simon Properties Group arising out of a breach of an employee stock option plan.

  • 2002 - A $1.6 million settlement on behalf of the Peoples Republic of China against Matthews International Inc. for breach of a joint venture agreement in the Peoples Republic of China

  • 2003 - Appointed class counsel in Helman, et al. v. Prolong International Corp., et al. A stock fraud case pending in Columbiana County, Ohio.

  • 2003 – A $1.1 million judgment against a newspaper publisher for breach of a stock redemption contract.

  • In addition to the above, Mr. Shimko has successfully litigated and settled hundreds of other claims for clients suffering catastrophic injuries from defective products, medical malpractice and automobile accidents.
